Topic:
Some people believe that there should be fixed punishment for each type of crime. Others, however, argue that circumstance of an individual crime, and the motivation for committing it, should always be taken into account when deciding on the punishment. Discuss both these views and give your own opinion.

Since the beginning of recorded time, those who committed a crime were punished differently. Each culture have varieties of punishment for each type of crime. However, nowadays, some believe that each type of crime should have a fixed punishment. While others, believe that it is necessary to analyse the factors that motivated the person to commit the crime before selecting a punishment. This arguments will be analysed prior to coming to a reasoned conclusion.

It is felt by many that types of crimes should have pre-established penalties. For example, countries that allow capital punishment, particularly Saudi Arabia, directly use the death penalty if the criminal has killed any victim. It goes without saying that the judgement in this case will be finished faster, due to the lack of investigation needed. Thus, it is easy to see why this argument has garnered a lot of support.

However, many holds the idea that the circumstances and motivation of a crime should be considered before deciding to use a penalty. A fact that support this idea is when a crime is committed in your own defence, such as, injuring an individual that was trying to steal your wallet. It is obvious when looking at this example that only the circumstances will truly show who was the guilty and the victim. Thus, the theory of verify the circumstances and motivation before judging a crime is difficult to debunk.

After analysing these two points of view, it is believed that the research in scenario behind each crime will fortify the accuracy of the judgements. Although it takes more time to come out with a result, it drastically decrease the punishment of innocent people.
